General Conditions of Sale (GCS) for purchases made online on the website www.ryell.it

Ryell SrlS, Via Benedetto Croce, 42, 75013 Ferrandina (MT), (“Ryell”) invites users to read these General Conditions of Sale (“GCS”) which regulate the purchase of products and the management of orders placed on the site.

1. Conclusion of the contract and delivery of the products

1.1 Every order placed on www.ryell.it implies the conclusion of a sales contract in Italian. When the order relates to a Ryell Product, a single contract is concluded between the buyer and Ryell SrlS, Via Benedetto Croce, 42, 75013 Ferrandina (MT).

1.2 By clicking on the “Buy Now” button, the customer places a binding order for the items contained in the virtual shopping cart. Once the order has been sent, Ryell will send the customer an e-mail confirming the order within 1 hour. The sales contract is concluded between Ryell and the customer when the latter receives the order confirmation. If the customer does not receive any order confirmation within the deadline indicated in this art. 1.2., The relative order must be considered rejected by Ryell and, therefore, ineffective.

Orders in relation to which the customer has opted for prepayment will be shipped as soon as Ryell has received full payment of the purchase price and any shipping costs. Ryell therefore invites the customer to pay the price as soon as the order is confirmed and in any case within the following 7 days.

1.3 Where the products covered by the order are not available for reasons independent of Ryell’s conduct, the latter must promptly notify the customer. In this case, there will be no obligation for Ryell to deliver the ordered goods, unless Ryell has assumed the supply risk in relation to the products that make up the order in question.

In any case, if the ordered products are not available, Ryel will refund, in favor of the customer, any sum already paid.

1.4 Ryell only makes deliveries in the Italian territory. If the delivery time is expressed in working days, it means as such all those included between Monday and Friday, with the express exclusion of any holidays.

2.Prices, shipping costs and express delivery

2.2 Shipping costs are the responsibility of the customer and not Ryell.

2.3 Express delivery is only available for some products. At the time of placing the order, the customer will see, if available, the possibility of opting for express shipping and the related additional costs. If the delivery does not take place within this deadline, the customer will be reimbursed for the shipping costs incurred.

2.4 Shipping costs in Italy have a flat rate of € 7.00. For purchases of € 100 or more, shipping costs are included.

3. Payment

3.1 Ryell accepts various payment methods including, for indicative purposes: by credit card, by bank transfer, Paypal and cash on delivery. Ryell reserves the right to refuse certain payment methods and to request different payment methods for certain orders. Note that Ryell only accepts payments from bank accounts within the European Union (EU) and that the customer is responsible for any costs associated with the transaction.

3.2 In the case of a purchase made with a credit card, the charge is made at the time of shipment of the order.

3.3 The buyer agrees to receive invoices and credits exclusively in electronic format.

4.Use of promotional vouchers

4.1 Promotional vouchers cannot be purchased, they are offered by Ryell as part of promotional campaigns and can be used for a limited period of validity.

4.2 Promotional vouchers can be used only once in relation to a single order, within the specified validity period. It is possible that for the purchase of some products the possibility of using promotional vouchers is excluded. Promotional vouchers cannot be used for the purchase of gift vouchers. It is possible that the use of a promotional voucher is subject to a minimum amount of expenditure.

4.3 The value of the products purchased must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the products ordered, the difference can be paid through any of the accepted payment methods referred to in Article 3 above. Promotional vouchers are not redeemable in cash and do not accrue interest on the credit represented by them. Promotional vouchers will not be refunded if the buyer decides to partially or completely return the ordered products.

4.4 Promotional vouchers can only be used if the order is finalized, they cannot be used retroactively and cannot be transferred to third parties. Unless otherwise provided by Ryell, it is not possible to combine several promotional vouchers for the same order. 4.5 If during the order the customer has used a promotional voucher and if the total value of the order – due to the customer’s withdrawal – should be less than the value of the promotional voucher, Ryell reserves the right to invoice the original price of the goods that remain in the possession of the customer.

5.Use of gift vouchers

5.1 Gift vouchers can be purchased, and can only be used for the purchase of Ryell Products but not for the purchase of additional gift vouchers. If the value of the gift vouchers is not sufficient to cover the value of the products ordered, the difference can be paid through any of the accepted payment methods.

6. Right of Withdrawal for Ryell Products

The customer has the right to withdraw from any order concerning Ryell Products, without giving any reason and with any declaration, provided that it is explicit, delivered to Ryell.

If the customer intends to return the purchased products, he can use the return label received with the order or can print a new one via his personal page accessible from the Ryell website. If the customer does not have access to a printer, if they have problems downloading the return label or if they need a new label, they can contact Customer Service (see the contact details indicated at the bottom of the page) and request one. . Please always use the return label provided by Ryell in order to avoid unnecessary additional costs.

6. Right of Withdrawal for Ryell Products

Once the registration has been completed, the Customer can select one or more Products which he intends to purchase, inserting them in a virtual “cart”, of which he can always view the contents before proceeding with the placing of the Order.

6.1 Information regarding the right of withdrawal (pursuant to Article 49, paragraph 1, letter (h) of Legislative Decree n. 206/2005 “Consumer Code”)

The customer has the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. To exercise the right of withdrawal, it is necessary to inform Ryell (Ryell SrlS, Via Benedetto Croce, 42, 75013 Ferrandina) of the decision to withdraw from this contract through any explicit declaration to that effect (for example, with a letter sent by post, fax or e-mail). To this end, it is possible, but not mandatory, to use the standard withdrawal form which can be downloaded here or to use the standard text indicated in point 6.3. Where the customer decides not to use the attached standard withdrawal form, he must submit any other explicit declaration of his decision to withdraw from the contract.

It is also possible to electronically fill in and send the standard withdrawal form or any other explicit declaration to that effect via the Ryell website. In this case, Ryell will promptly send an acknowledgment of receipt of the withdrawal on a durable medium (e.g. by e-mail). The deadline set for the withdrawal is considered respected if the customer submits his declaration before the expiry of the 14-day deadline starting from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the event of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day term starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.

6.2 Effects of withdrawal

Following the withdrawal from this contract, Ryell will reimburse all payments made by the buyer, including delivery costs (with the exception of any additional costs resulting from the choice of a type of delivery other than the standard one offered by Ryell), without undue delay. and in any case no later than 14 days from the day on which Ryell is informed by the customer of the decision to exercise the right of withdrawal. These refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise agreed. In any case, the customer will not have to incur any costs as a consequence of this reimbursement. The refund may be suspended until Ryell has received the returned products or until the customer demonstrates that such goods have been shipped, whichever is earlier.

The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the sales contract.

The Products must be returned

– properly packaged in their original packaging, not damaged, damaged or soiled and equipped with any accessories, instructions for use and documentation;

– with the transport document (present in the original packaging), in order to allow Ryell to identify the customer (order number, name, surname and address);

– without obvious signs of use, other than those compatible with carrying out a normal test of the article (they must not bear traces of prolonged use or in any case exceeding the time necessary for a test and must not be in such a state as not to allow resale).

If the returned product does not comply with the provisions of the previous paragraph, the withdrawal will not be effective.

The costs of the return will be borne by the customer. The customer is responsible for any decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products themselves.

8. Possibility to make the return up to 100 days from receipt of the products

8.1 Without prejudice to the right of withdrawal provided for by law, Ryell offers the possibility of returning the purchased products up to 100 days from receipt of the same. This possibility allows the customer, after the 14-day deadline for withdrawal (see the previous point “Information regarding the right of withdrawal”), to dissolve the contract by returning the ordered products to Ryell within 100 days from the date of receipt. of the products themselves.

8.2 For the return of Ryell products, the customer can use the return label contained in the order or can print the label via his personal page on the Ryell website. The customer can contact Customer Service in case of problems with the download of the return label or if he does not have access to a printer.

8.3 The deadline is considered respected if the customer sends the goods before the deadline of 100 days has expired. However, the possibility of extended returns can only be used if the customer has tested / tried the products in the same way and with the same care that he would have used in a physical store and always provided that the products are returned in their original condition, intact, without damage. and in the original packaging. In any case, in the short term of 14 days from receipt of the products, the provisions of Legislative Decree 206/2005 (Consumer Code) on the subject of withdrawal. The possibility of returning the products does not in any way limit the legal guarantee that belongs to the customer without any reservation. The ability to return products does not apply to orders placed using a gift card.

9. Refunds

Invoices will be issued exclusively in electronic format.

9.1 Refunds are credited directly to the account or payment instrument used at the time of purchase. For payments made by bank transfer, the refund will be made to the account used for the payment. For payments made via Paypal or credit card, the refund will be made to the Paypal account or credit card. For payments made by cash on delivery, the refund will be made, alternatively, to the current account that the customer will indicate to Ryell or by crediting the customer’s account.If a gift voucher was used for the order, Ryell will re-credit the relative sum on the customer’s account.

11. Warranty for defects and non-conformities of the products and additional information

11.1 Purchases made on Ryell are subject to the rules of the Consumer Code regarding the guarantee for product defects and discrepancies. The customer will therefore be granted the rights referred to in art. 130 of the Consumer Code and these rights must be exercised under the terms of art. 132 of the same Consumer Code.

11.2 These GCS can be consulted on the website www.ryell.it and can be saved using the relative browser command. It is also possible to save and archive them in PDF format by clicking here. In order to open the PDF file, you need to have Adobe Reader installed on your computer, which can be downloaded for free from the website www.adobe.it, or other similar software.

11.3 It is possible to archive the order details and download the GCS using the relative browser command to save the order summary that appears in the last screen of the purchase process, or waiting to receive the automatic order confirmation message that Ryell sends via email following the completion of the order. This confirmation message includes the details of the order and Ryell’s GCS, and can easily be printed or saved using the functions made available by the e-mail programs.

12. Applicable law

12.1 These GCS and sales contracts are governed by Italian law (and in particular by the Consumer Code – which in articles 46 to 67 governs distance contracts – and by Legislative Decree 70 of 09/04/2003 on e-commerce) and in the light of this they must be interpreted.

12.2 For any dispute that may arise in connection with the GCS and / or sales contracts, customers can activate an out-of-court dispute resolution procedure in compliance with the requirements set out in Articles. 141 and ss. of the Consumer Code. In the event that the Customer activates the aforementioned procedure, Ryell guarantees its participation in an attempt at an amicable settlement that the user can promote before RisolviOnline, an independent and institutional service provided by the Chamber of Arbitration of the Milan Chamber of Commerce.
